Durante il pontificato di Papa Francesco sono stati numerosi i provvedimenti (generalmente nella forma del motu proprio) attraverso i quali sono stati creati o soppressi diversi enti od organismi del governo centrale della Chiesa. Si aspettava, però, una riforma generale della Curia, mediante una Costituzione apostolica che ridisegnasse il quadro normativo nel suo complesso, dando stabilità alle molte riforme parziali. Questa attesa è terminata il 19 marzo 2022 quando, sul Bollettino della Sala Stampa della Santa Sede, è apparso il testo della legge di riforma con il titolo «Costituzione apostolica Praedicate evangelium sulla Curia Romana e il suo servizio alla Chiesa nel mondo». Il libro è un commento alla Costituzione apostolica Praedicate evangelium (integralmente riportata in Appendice), letta alla luce della storia secolare della Curia Romana. Si tratta di un sussidio rivolto agli esperti di materie giuridiche, in particolare ai canonisti, agli studenti delle Università e a tutti coloro che vogliono conoscere la struttura e il funzionamento del governo centrale della Chiesa.

Prosegue, quindi con la trattazione dei doveri e dei diritti dell'avvocato nelle cause per la dichiarazione di nullità di matrimonio, considerati alla luce della riforma di Papa Francesco e delle differenze fra la disciplina processuale ormai vigente e quella precedente, e si conclude con l'analisi del profilo dell'avvocato ecclesiastico nel contesto ecclesiale italiano, alla luce dei provvedimenti adottati dalla Conferenza Episcopale Italiana e delle riforme che hanno interessato l'ordinamento civile italiano tanto sul diritto di famiglia quanto sull'ordinamento forense. L'obiettivo dell'intera opera è quello di sottolineare la dimensione umana sottesa alle cause per la dichiarazione di nullità di matrimonio, nonché di riscoprire il senso più profondo del lavoro e della missione del patrono ecclesiastico nell'assistere i fedeli che si rivolgono alla Chiesa per ricevere una parola di verità e di giustizia sul loro vincolo coniugale.

Il motu proprio Mitis Iudex Dominus Iesus ha apportato cambiamenti concreti e rilevanti al processo matrimoniale canonico nell’ottica di una vera e propria conversione, anzitutto del pensiero e poi delle strutture. Tuttavia, a distanza di anni dalla sua pubblicazione, persistono dubbi sull’applicazione di alcuni aspetti della riforma. Il riferimento è al processus brevior, di cui talvolta si registrano interpretazioni eccessivamente libere e applicazioni concrete discutibili. Da tali perplessità nasce l’idea di affrontare una quaestio discussa dai canonisti e dagli operatori dei tribunali ecclesiastici, vale a dire se sussistano condizioni per la trattazione di cause di nullità matrimoniali riferite al canone 1095 attraverso lo strumento del processus brevior coram Episcopo. Lo scopo del presente studio (che non pretende di fornire soluzioni definitive e indiscutibili), è individuare i presupposti che rendano possibile la relazione tra questo nuovo strumento processuale e il canone inerente all’incapacità consensuale, oltre ad offrire una panoramica sulle innovazioni apportate dal Mitis Iudex e sulle evoluzioni del canone 1095.
